SUBJECT: Overtime, Prescribed Hours of Duty, and Alternative Work Schedules for Civilian
Employees

1. PURPOSE. This Administrative Instruction (AI):
a. Reissues AI 28 (Reference (a)) in accordance with the authority in DoD Directive 5110.04
(Reference (b)) and DoD Instruction 5025.01 (Reference (c)).
b. Incorporates and cancels Director of Washington Headquarters Services Memorandum
(Reference (d)) and Director of Administration and Management Memorandum (Reference (e)).
c. Implements policies and updates responsibilities and procedures regarding civilian hours
of duty and overtime pay administration in accordance with chapter 8 of title 29, United States
Code (U.S.C.) (also known and hereafter referred to as “The Fair Labor Standards Act (FLSA) of
1938, as amended” (Reference (f))) and sections 5550b, 6101, 6103, 6122, 6124, 6126, and 6127
of title 5, U.S.C. (Reference (g)).
2. APPLICABILITY
a. This AI applies to OSD, the Office of the Chairman of the Joint Chiefs of Staff and the
Joint Staff, the Defense Agencies, and the DoD Field Activities in the National Capital Region
that are serviced by Washington Headquarters Services (WHS) (hereafter referred to collectively
as the “WHS-Serviced Components”). This AI shall be used in conjunction with any applicable
labor agreements.
