This instruction implements the guidance of Air Force Policy Directive (AFPD) 51-5,
Administrative Law, Gifts, and Command Relationships. This instruction aligns with Title 10 of
the United States Code (USC), the inherent authority of commanders, and is consistent with the
applicable portions of DoD 5500.7-R, the Joint Ethics Regulation (JER), authorized by DoD
Directive 5500.7, Standards of Conduct, as well as Parts 2635 and 3601 of Title 5 of the Code of
Federal Regulations (CFR). This instruction establishes internal agency procedures for
processing requests for approval of outside employment and business activities as outlined
within sections 2-206a and 3-304 of DoD 5500.7-R (JER) and the CFR. This instruction also
delegates to commanders and supervisors the authority expressly granted by sections 2-303 and
3-304c of DoD 5500.7-R (JER) and the CFR to require DoD employees under their jurisdiction
to report/seek prior approval for any outside employment and business activities prior to
engaging in them. All military and civilian personnel assigned to the AFMC, including any
Reserve or National Guard members on active duty orders issued pursuant to Title 10 USC, who
are seeking outside employment or seeking to engage in business activities, or, who currently
hold outside employment or currently engage in business activities without an approved AF
Form 3902 in place, are required to submit an AF Form 3902, Application and Approval for Off-
Duty Employment. Approval is not required for the regular civilian employment of Reservists
and Guard members working at the AFMC, however, all other ethics laws and regulations are
applicable to that employment. This instruction applies to all AFMC Regular Air Force (RegAF),
Air Force Reserve and Air National Guard units. Ensure that all records created as a result of
processes prescribed in this publication are maintained in accordance with (IAW) AFI 33-322,
Records Management and Information Governance Program, and disposed of IAW Air Force
