PROCEDURE FOR SUBMITTING ARTICLE 15 PACKETS
The purpose of this document is to provide a reference for submitting Article 15
packets. This format will ensure packets are completed in a timely manner and
returned to the unit as soon as possible.
For Article 15s, [Summarized, Company Grade, or Field Grade,] certain items
must be submitted with the initial packet to properly process the unit's request:
a. Legal request form: This form must be filled out by the commander stating
what type of action is being requested.
b. Supporting Documents: Evidence must be included to support the offense the
soldier allegedly committed. The unit must submit the following supporting
documentation:
1. Counseling statements: These counseling statement(s) must include
the offense committed, the date the offense occurred, and the fact that the
soldier was being counseled for the offense committed.
2. DA FORM 2823 (Sworn statements): Used when there were witnesses
to the offense committed. These statements need to include who was
involved, what happened, where it happened, and when it happened.
3. Blotter reports/MP reports: If a blotter or MP report was completed, it
must be included in the packet before the request can be processed.
4. DA Form 4187: Provided when the soldier has gone AWOL. One DA
Form 4187 placing the soldier AWOL and one DA Form 4187 returning the
soldier to present for duty must be provided.
5. Any other supporting documents; such as copies of bad checks,
invoices for bad debts, etc. (If these debts have been paid, you can no
longer ask for UCMJ action for failing to pay a debt or uttering worthless
checks.)
6. A DA Form 268 and the soldier's ERB must also be submitted before a
request can be initiated.
c. You can find a suggested notification guide per AR 27-10, Appendix B,
paragraph B-2, to assist you in the initial reading. After the initial reading, the
service member must be given the opportunity to speak to Trail Defense
Services (TDS) within 48 hours. The SM also has the right to appeal to the next
superior authority within 5 calendar days after the punishment is imposed.
