HOWTO INFORM SUSPECT OF PROVISIONS OF THE
IMPLIED CONSENT POLICY IAW 190-5
IMPLIED CONSENT WARNING
BEFORE A CHEMICAL TEST IS PRESENTED TO THE
SUSPECT, INFORM HIM/HER OF THE FOLLOWING:
1. Implied Consent means that any person given
the privilege of operating a motor vehicle on a
military installation or area under military
control, to include overseas areas, shall be
deemed to have given his or her consent to a
chemical test of his or her blood, breath, or
urine for the purpose of determining the
alcoholic content of his or her blood if
lawfully stopped, apprehended, or cited for
any offense allegedly committed while under
the influence of intoxicating liquor.
2. (For Stateside) If you refuse to take the
chemical test or fail to complete the test, you
may lose your on-post driving privilege.
(For Overseas) If you refuse to take the
chemical test or fail to complete the test,
you may loose your on and off post driving
privilege.
3. You do not have the right to have an attorney
present before stating whether or not you will
submit to the test or during the test.
